ORDER The present Civil Revision Petition has been filed against the fair and decreetal order, dated 12.01.2023 passed in I.A.No.437 of 2018 in O.S.No.274 of 2013 passed by the learned Principal District Munsif Court, Musiri.

¶2The petitioner is the first defendant in O.S.No.274 of 2013. The said suit has been filed by the first respondent herein for declaration that the first respondent is the owner and for permanent injunction to restrain the petitioner from interfering with the peaceful possession of the property and to declare the decree obtained by the petitioner's paternal uncle in O.S.No.845 of 1982 on 13.10.1993 as null and void.

¶3The learned Principal District Munsif Court, Musiri has rejected the application in I.A.No.437 of 2018 in O.S.No.274 of 2013 filed by the petitioner under Order 7 Rule 11 of C.P.C with the following observations: "9.kDjhuh;-1k; vjph;thjp jug;gpy; jhth nrhj;J rh;Nt vz;.147/2B Vf;fh; 1.50 nrd;l; epyk; kw;Wk; ,t;tof;fpy; fhz;gpf;fg;glhj NtW rpy nrhj;Jf;fis Nkw;gb nrhj;Jf;fspd; Kd;ghj;jpa];juhd mutd; %g;gd; vd;gth; Nkw;gb Jiurhkp nul;bahUf;F &.12>000/-Bf;F fpiuak; nra;J nfhLf;f xg;Gf;nfhz;L 15.04.1977k; ehspl;l fpiua xg;ge;j gj;jpuk; vOjpf;nfhLj;Js;sjhf nrhy;ypAs;shh;. ¶4The facts that was stated by the petitioner seems to indicate that the land originally belonged to one Aravan Muppan, who executed a sale agreement on 15.04.1997 in favour of one Duraisamy Reddiyar. After executing a sale agreement, the said Aravan Muppan died on

16.06.1977. Under these circumstances, the said Duraisamy Reddiayar filed O.S.No.556 of 1981 before the Sub Court, Trichy against the four sons of the late.Aravan Muppan. The said suit was later re-numbered as O.S.No.845 of 1982 on the file of the District Munsif Court, Musiri. The suit came to be decreed on 13.10.1993. It appears that in the suit, four sons of late.Aravan Muppan had sold the land to the fifth defendant, who in turn sold to the sixth defendant, namely, Solaiappan, who in turn sold to one Rathinam, who ploted the land and sold to the respondent on

01.04.1985. The respondent had apparently no knowledge that the suit came to be instituted as early as on 1981 in O.S.No.556 of 1981 before the Sub Court, Trichy and late re-numbered as O.S.No.845 of 1982 before the Principal District Munsif Court, Musiri. Further, appeal in A.S.No.21 of 1994 is also said to be dismissed.

¶5The petitioner claims to be the owner of the property by virtue of the registered Will executed by late Duraisamy Reddiyar on

17.11.2006 vide Document No.71 of 2006. The petitioner claims to be said Duraisamy sister's daughter husband.

¶6In my view, the order rejecting the application filed by the petitioner under Order 7 Rule 11 of C.P.C does not call for any interference. The rights of the respondent to declare the sale deed executed in favour of the said Duraisamy Reddiyar is required to be determined after trial. There is no merit in the civil revision petition.

¶7The present Civil Revision Petition stands dismissed with the above observations. The learned Principal District Munsif Court, Musiri is directed to proceed with the trial and dispose of the suit in O.S.No.274 of 2013 as expeditiously as possible preferably within a period of 12 months on merits and in accordance with law from the date of receipt of copy of this order. No costs. Consequently, connected miscellaneous petition is closed.
