Judgment

O R D E R This Court, having taken note of Paragraph No.10 of the counter-affidavit filed by the third respondent, prima facie came to the conclusion that a calculated attempt was made to mislead this Court by the deponent of the said counter-affidavit. Hence, this Court, vide order dated 20.07.2026, directed the third respondent to file an affidavit explaining as to why he should not be prosecuted for having filed a false counter-affidavit before this Court and also to show cause as to why appropriate contempt proceedings be not initiated against him.

¶2Accordingly, this matter is listed today. Today, an affidavit is filed by one P.Jayanthi, Daughter of M.V.Pasupathy, who is stated to be holding the office of the third respondent with effect from 01.07.2026. It is also brought to the notice of this Court by way of the said affidavit that the person, who has sworn the earlier counter-affidavit of the third respondent, has retired from service on 30.06.2026 and therefore, the officer, who is holding the office of the third respondent as on date, has filed the affidavit. The intention of the Court, while passing the order dated 20.07.2026, is to call upon the deponent of the earlier counter-affidavit, who was holding the office of the third respondent at the relevant point of time, to file an affidavit as to why he should not be prosecuted and as to why contempt proceedings be not initiated against him. In stead of the deponent of the earlier counter-affidavit filing an affidavit, the officer, who is now holding the office of the third respondent, has filed the affidavit. As it is brought to the notice of this Court that the deponent of the earlier counter-affidavit is no more in service, this Court deems it appropriate to implead the deponent of the earlier counter-affidavit as a party respondent in this writ petition for taking further steps.

¶3Accordingly, the deponent of the earlier counter-affidavit, namely, Dr.M.Hameed Ali, Son of P.Mohamed Farook, residing at No.8, Gandhiyadigal Salai, R.P.Sivam Nagar, Mannargudi, Thiruvaur, Tamil Nadu-614 001, is suo moto impleaded as sixth respondent in this writ petition.

¶4Registry is directed to carry out necessary amendment and issue notice to the newly impleaded sixth respondent returnable by

20.08.2026.

¶5List the matter on 20.08.2026.
