Judgment
ORDER The present Writ Petition has been filed for the issuance of a Writ of Mandamus, directing the 2nd respondent to dispose the petitioner's representation dated 05.02.2024 and 06.03.2026 within a stipulated time that may be fixed by this Court.
¶2Mrs.S.Jeya Priya, learned Government Advocate, takes notice for the respondents 1 to 3.
¶3By consent of both parties, the writ petition is taken up for final disposal at the stage of admission.
¶4The contention of the petitioner is that Sundararajapuram Village comes under the control of Seithur Zamin. The Zamindar extended support for the worship of the Mariamman Temple and also endowed several agricultural lands in the name of the temple for performing poojas and other religious activities. The land in Survey No. 308/5, situated at Sundararajapuram Revenue Village, Rajapalayam Taluk, stood in the name of V.T.S. Sevugapandia Thevar and the Mariamman Temple under Patta No. 394. The fourth respondent, with an intention to grab the temple land, has created a fraudulent document. Based on the same, the fourth respondent has obtained a patta in respect of the said survey number. Hence, the petitioner has submitted a representation seeking cancellation of the patta issued in favour of the fourth respondent.
¶5The learned Government Advocate, on instructions, submitted that the petitioner has not produced relevant documents, but the petitioner has submitted a copper pattayam. If the petitioner produces the relevant documents, the respondents will consider his representation and pass appropriate orders.
¶6It is observed that even if the copper pattayam establishes the Zamindar's ownership, the fourth respondent is also required to prove his entitlement to the property in accordance with law.
¶7In view of the above, the Revenue Divisional Officer, Sivakasi, Virudhunagar District, is directed to consider the petitioner's claim after issuing notice to the petitioner, the fourth respondent, other rival parties, if any, and the temple authorities, and to pass orders on merits and in accordance with law within a period of four months from the date of receipt of a copy of this order.
¶8With the above direction, the writ petition stands disposed of. No costs.
