.In the said suit, the respondent had also filed I.A.No.3 of 2019 for appointment of an Advocate Commissioner to give a report under Order 26 Rule 9 of CPC. Perusal of the order passed by the Trial Court on 25.04.2019, the Advocate Commissioner has given a report on 27.10.2020. Mean while, the petitioners/defendants also filed their written statement disputing the claim of the respondent in respect of 'B' schedule property which is a pathway. The petitioners have filed I.A.No.14 of 2020 for appointing a new Advocate Commissioner to scrap the report of the Advocate Commissioner.
.The learned counsel for the petitioners submits that the description of the property disputed in schedule 'B' & the sketch annexed to the plaintiff's vendor sale deed dated 06.01.2012, the description of the property in the sale deed in favour of the plaintiffs vide sale deed dated 28.11.2018 are in variance with the schedule in the plaint. It submitted that the petitioners' right over 'B' schedule property is ½ cents. Whereas, the respondent is claiming rights over the entire extent of 4 cents of land meant for pathway. It is further submitted that the report given by the Advocate Commissioner on 27.10.2020 is enormous and ought to have scrapped by the Trial Court.
.I have considered the argument advanced by the learned counsel for the petitioners.
.The petitioners are aggrieved by the report given by the Advocate Commissioner dated 27.10.2020. It is always open for the petitioners to adduce oral and documentary evidence to establish that the respondent has no right over the entire extent of 'B' schedule property. The prayer that has been rightly rejected by the Trial Court. This Court does not find any reason to interfere with the impugned order.
.The suit is of the year 2019. Since the petitioners filed written statement, the Trial Court is directed to frame issues and proceed with the trial as expeditiously as possible and closure to the dispute one way or other.
.With the above direction, this Civil Revision Petition is dismissed. No costs. Consequently, the connected miscellaneous petition is closed.
