Raja Bhai Selwyn v. The Dist. Collector

ORDER This Writ Petition is filed for issue of a Writ of Mandamus, directing respondents 1 to 3 to forbear the 4th respondent from constructing any place of worship as well as from using loud speakers and creating noise with drums and etc., in his premises at No.4/13A, North Street, Neyyoor, Kanyakumari District by considering the representations dated 10.06.2020, 11.06.2020 and 22.06.2020.

¶2It is informed that the application filed by the fourth respondent to convert a house into a Church premise is pending before the District Collector, Kanyakumari. The move to convert a residence into a Church has been seriously opposed by the writ petitioner herein and others stating that it would result in great deal of prejudice and harassment to the local residents.

¶3Be that as it may, considering the fact that the application is pending, the District Collector, Kanyakumari, is directed to dispose of the same within a period of eight weeks from the date of receipt of a copy of this order, after hearing all the concerned parties and affording personal hearing to them.

¶4With the above direction, this Writ Petition is disposed of. No costs. Consequently, connected miscellaneous petitions are closed.
