PETITION FOR BAIL Under Sec.439 of Cr.P.C. PRAYER :- For Bail in Crime No.51 of 2023 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner /Accused who was arrested and remanded to judicial custody on 30.03.2023 for the offence under section 379 of IPC in Crime No.51 of 2023 on the file of the respondent police seeks bail.
¶2The case of the prosecution is that the petitioner/accused said to have committed theft of 66 bundles of 2mm iron rod, hence the case.
¶3Heard both sides and perused the materials available on record including the First Information Report.
¶4It is seen that the petitioner is a habitual offender of theft. In the present case he has stolen 66 bundles of 2mm iron rod and the property was recovered from the petitioner. The petitioner was arrested only on 30.03.2023. That apart the petitioner sofar involved in 28 previous cases which are similar in nature and if the petitioner is let on bail, he will indulge in similar type of offences again, hence this Court is not inclined to grant bail to the petitioner.
