Additional Public Prosecutor PETITION FOR BAIL Under Sec.439 of Cr.P.C. PRAYER :-For Bail in Crime no.95/2023 on the file of the Respondent Police ORDER : The Court made the following order :-

The petitioner /A1 who was arrested and remanded to judicial custody on 01.04.2023 for the offences under sections 454 and 380 of IPC in Crime No.95 of 2023 on the file of the respondent police seeks bail.

¶2The case of the prosecution is that the petitioner said to have robbed 10 sovereigns of gold chain from the defacto complainant, hence the case.

¶3Heard both sides and perused the materials available on record including the First Information Report. It is reported that 15 previous cases are pending against the petitioner. CRL OP(MD). No.8040 of 2023

¶4It is seen that the petitioner is habitual offender and there are fifteen similar previous cases pending. In the present case he has robbed 10 sovereigns of gold chain and he was were arrested only on 01.04.2023. Taking into consideration of the facts and circumstances of the case and also the previous bad antecedents of the petitioner, this Court is not inclined to grant bail to the petitioner.
