Veerapandi.M v. The District Collector

O R D E R The Writ Petition has been filed in the nature of a Writ of Mandamus seeking to conduct survey of the lands in S.No.226/2A1 measuring 40.50 ares and in S.No.226/3A measuring 43 ares both at Alangulam Group, Keelakarai Taluk, Ramanathapuram District and to fix the boundary stones.

2.Heard the learned Counsel for the petitioner and the learned Additional Government Pleader for the respondents.

3.The learned Additional Government Pleader stated that for the land in S.No.226/2A1, patta in Patta No.723 had been issued in the name of the petitioner herein. However, with respect to the lands in S.No. 226/3A, patta in Patta No.132 had been issued in the name of Kalaivannan.

4.The learned Counsel for the petitioner states that Kalaivanan is the brother of the petitioner herein.

5.Before proceeding to conduct survey of the aforementioned land, an obligation is placed on the second respondent to issue notice to Kalaivannan, get his consent and thereafter conduct survey. If consent is not given, then necessary orders may be passed as to why survey could not be conducted by giving reasons. The entire exercise must be completed within a period of eight weeks from the date of receipt of a copy of this order.

6.The Writ Petition stands disposed of. No costs.
