Judgment
O R D E R [Order of the Court was made by R.SUBRAMANIAN, J.] Mr.V.Nirmal Kumar, learned Government Advocate, takes notice for the respondents 1 to 3.
¶2Considering the nature of the relief, notice to the private respondents is deemed unnecessary.
¶3With the consent of both sides, this writ petition is taken up for final hearing at the admission stage itself.
¶4The petitioner seeks the removal of encroachment on the ground that the land in question is a 'Government Poramboke land'. The Tahsildar, Alangulam Taluk, as in his instructions to the learned Government Pleader stated that Survey No.168/5C is treated as 'Natham' and it stands in the name of four persons including the petitioner and those persons are occupying the said land as the backyard and they have also erected borewells. Hence, we do not find any reason to entertain this writ petition. Thus, the writ petition fails and it is dismissed leaving it open to the petitioner to take appropriate civil proceedings, if he is so advised. No costs. [R.S.M., J.] [L.V.G., J.]
