ORDER The present Civil Revision Petition has been filed against the order, dated 10.03.2023 passed in I.A.No.183 of 2022 in H.M.O.P.No. 260 of 2021 on the file of the Subordinate Court, Thirumangalam.
¶2The petitioner herein has filed H.M.O.P.No.260 of 2021 for restitution of conjugal rights under Section 9 of the Hindu Marriage Act, 1955 before the Subordinate Court, Thirumangalam.
¶3In the said H.M.O.P., the respondents have filed I.A.No.183 of 2022 for interim maintenance for sum of Rs.45,000/- for herself and Rs.15,000/- each for two children. The Subordinate Court, Thirumangalam has partly allowed the application filed under Section 24 of the Hindu Marriage Act, by ordering interim maintenance of Rs.12,000/- only to the first respondent. The relevant portion of the order reads as under: "9. ,e;j epiyapy; 1-k; kDjhuh; ,k;kDtpy; fz;l 2>3 kDjhuh;fis guhkhpj;J tUk; epiyapYk;> 1-k; kDjhuUf;F cz;z czT> cLf;f cil> kUj;Jt nryT> cgajug;gpdh;fspd; Foe;ijfshd 2 kw;Wk; 3k; kDkhuh;fspd; fy;tpf;fhd nryT kw;Wk; ,t;tof;F nryT kw;Wk; ,ju nryTfis jw;NghJs;s tpiythrpia fUj;jpy; nfhz;L ghprPypf;Fk; NghJ> 1-k; kDjhuUf;F Fiwe;jgl;rk; khjk; &.12>000/- Njitg;gLk; vd;gjidg; nghWj;j mstpy; vej; khw;Wf; fUj;Jk; ,Uf;f tha;g;gpy;iy. ,e;epiyapy; ,e;j kDtpy; Kd;dpiyg;gLj;jg;gl;l rq;fjpfis xUNru ghprPypf;Fk; NghJ> 1-k; kDjhuUf;F kl;Lk; Nkw;fz;l fhuzq;fspd; mbg;gilapy; mry; kD KbAk; tiu vjph;kDjhuh;> ,k;kDj;jhf;fy; NjjpapypUe;J ePjpapd; ghy; ,ilf;fhy [Pthdk;rkhf khjk; &.12>000/- toq;f cj;juT gpwg;gpf;fyhk; vd;W ,e;j ePjpkd;wk; KbTnra;J ,g;gpur;ridf;F jPh;T fhz;fpwJ.

¶4The learned counsel for the petitioner submits that the respondent is employed in a school where the children of the petitioner and the respondent are studying. That apart, it is submitted that the respondent is also taking home tuition and earning substantial amount through private tuition. It is further submitted that the respondent has refused to re-join the matrimonial home and filed I.A.No.183 of 2022, which is culminated in the impugned order.
¶5The learned counsel for the petitioner placed reliance on the following decisions in support of the case.
(i) Chand Dhawan (Smt) Vs Jawaharlal Dhawan reported in 1993
(3) SCC 406.
(ii) Kumaresan Vs Aswathi reported in (2002) 2 MLJ 760
(iii) Natesa Udayar and others Vs Adham (for himself and representing the Villagers of Keelavalaivu Udayar Community people of Melarasur Village, Lalgudi Taluk, Trichy District) reported in (2003) 1 MLJ 752
(iv) Anu Kaul Vs Rajeev Kaul reported in (2009) 13 SCC 209.
(v) Neeta Rakesh Jain Vs Rakesh Jeetmal Jain reported in (2010) 12 SCC 242
(vi) Bhushan Kumar Meen Vs Mansi Meen Alias Harpreet Kaur reported in (2010) 15 SCC 372.
¶6I have considered the arguments advanced by the learned counsel for the petitioner. The petitioner has not produced any documents to substantiate the plea regarding the first respondent being employed. The petitioner is duty bound to maintain her wife and children.
¶7The respondents are entitled to maintenance. There is no merit in the challenge to the impugned order. Therefore, the present Civil Revision Petition stands dismissed without prejudice to the rights of the respondents to seek enhancement of interim maintenance. No costs. Consequently, connected miscellaneous petition is closed.
