For Appellants : Ms.J.Saranya, Government Advocate For Respondent : Mr.A.Syed Abdul Khader COMMON JUDGMENT (Common Judgment of the Court was made by M.DHANDAPANI.J.) These Intra-Court Appeals have been filed challenging the orders passed by the learned Single Judge of this Court in W.P.(MD) Nos.11566, 12436, 11916 and 11915 of 2019 dated 08.05.2019, 29.05.2019, 15.05.2019 and

15.05.2019 respectively.

¶2The learned Government Advocate appearing for the appellants would submit that the writ petitioners filed the aforesaid writ petitions seeking issuance of a Writ of Certiorarified Mandamus, calling for the records relating to the order passed by the third respondent dated 20.03.2019 and quashing the same, and consequently directing the appellants to appoint the respondents as Sub-Inspectors of Police (Finger Print) in the Tamil Nadu Police Service pursuant to the recruitment process conducted during the year 2018, with all consequential benefits.

¶3The learned Single Judge allowed the writ petitions, following the earlier order passed by this Court in W.P.(MD) No.5441 of 2019 etc., batch dated 30.04.2019, wherein similar relief had been granted. Aggrieved by the said orders, the State preferred Intra-Court Appeals before this Court in W.A.

(MD) Nos.941 to 953 of 2020. The said appeals were dismissed by this Court on 15.02.2021. Thereafter, the State preferred Special Leave Petitions before the Hon'ble Supreme Court in SLP(C) Nos.13876-13888 of 2021. The Hon'ble Supreme Court, by order dated 28.07.2026, disposed of the said Special Leave Petitions. The relevant portions of the order are extracted hereunder: "3. Having considered the contentions made across the Bar and perused the materials available on record, we find that the impugned judgments have been delivered in the attending facts and circumstances and warrant no interference.

¶4On 21.07.2026, this Court passed the following order: "1. Learned counsel for respondent(s), under instructions, submits that respondents are ready to forego their back wages.

¶2To enable the learned counsel for the petitioners to seek instructions, matter is adjourned.

¶3List on 28.07.2026."

¶5The respondents shall abide by the same.

¶6We expect the petitioners to abide by the impugned judgments / orders within three months from today.

¶7Accordingly, the Special Leave Petitions stand disposed of, leaving the question of law open. The impugned judgments / orders shall not be treated as binding precedents.

¶8Pending applications, if any, including the application (s) seeking intervention / impleadment shall stand disposed of."

¶4In view of the aforesaid order passed by the Hon'ble Supreme Court and considering the fact that the respondents herein are similarly placed persons, we are inclined to extend the very same benefit to the respondents herein, subject to the terms and conditions stipulated by the Hon'ble Supreme Court in its order dated 28.07.2026.

¶5Accordingly, these Writ Appeals stand disposed of in the above terms. There shall be no order as to costs. Consequently, connected miscellaneous petitions are closed. [M.D.I.,J] [N.D.K.,J]
