For Petitioners :Mr.G.Murugesan For Respondent :Mr.B.Nambi Selvan Additional Public Prosecutor

PETITION FOR ANTICIPATORY BAIL Under Sec.482 of BNSS PRAYER :- For Anticipatory Bail in Cr.No.139 of 2026 on the file of the respondent police. ORDER : The Court made the following order :-

¶2The case of the prosecution is that on

08.04.2026, during a temple festival, due to previous enmity, the petitioners and other accused persons abused the defacto complainant and attacked him with stick, aruval and caused injuries to him. Hence, the case.

¶3The learned counsel for the petitioners would submit that the petitioners are innocent persons and they were falsely implicated in this case and they are no way connected in the above said incident. He would further submit that it is a case in counter case. a counter complaint has been registered against the defacto complainant in Crime No.141 of 2026. Hence, he prays to grant anticipatory bail to the petitioners.

¶4The learned Additional Public Prosecutor appearing for the respondent Police would submit that the investigation is pending and the offences are grave in nature and the injured person has been discharged from the hospital and the petitioners 1 and 2 have no previous cases and the third petitioner has one previous case. However, he opposes to grant anticipatory bail to the petitioners.

¶5Heard both sides and perused the materials available on record.

¶6Considering the rival submissions on either side and the nature of offences charged against the petitioners and there was a dispute between the parties during temple festival and the counter complaint has been registered against the defacto complainant in Crime No.141 of 2026 and the petitioners 1 and 2 have no previous cases and though the third petitioner has one previous case, he was already released on bail, and also considering the fact that the injured person has been discharged from the hospital, I am inclined to grant anticipatory bail to the petitioners, subject to the following conditions: [a] Accordingly, the petitioners are ordered to be released on anticipatory bail on condition to execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.VI, Madurai, and on further conditions that: [b] the petitioners shall report before the respondent police once in a week ie., on Every Saturday at
