Judgment

ORDER The present petition has been filed by the defacto complainant in Cr.No. 374 of 2018, on the file of the 2nd respondent police, seeking to transfer investigation from the file of the 2nd respondent to any other competent person and further direct the 1st respondent to monitor the investigation.

¶2A perusal of the records reveal that FIR has been registered as against unknown persons for the alleged offences under Sections 454, 457 and 380 of IPC.

¶3According to the learned counsel appearing for the petitioner, there is no progress in the investigation for the past eight years and therefore, he seeks transfer of investigation.

¶4The learned Government Advocate (Crl. Side), appearing on behalf of the respondents submitted that he had verified the CDR records and that more than 200 persons had been investigated. He further submitted that the petitioner had suspected one Sagayaraj and that the fingerprints of the said Sagayaraj did not match the fingerprints found at the scene of occurrence. In such circumstances, efforts are being made to trace the accused and recover the stolen jewels.

¶5Heard the learned counsel on either side and perused the material records of the case.

¶6Since the FIR was registered against unknown persons around eight years ago, the accused have not yet been identified and the stolen jewels have not been recovered. Only two fingerprints were lifted from the scene of occurrence.

¶7In such view of the matter, the 1st respondent is directed to form a special team consisting of expert police personnel to investigate this type of crime. The 1st respondent is further directed to monitor the progress of the investigation. The charge sheet shall be filed within a period of four months from the date of the forming of the special team.

¶8The criminal original petition is disposed of with the above directions. Consequently, connected miscellaneous petition is closed.
