Judgment

O R D E R Heard the learned counsel appearing for the petitioner and the learned Government Advocate appearing for the respondents.

¶2This writ petition has been filed seeking a direction to the respondents to reinstall the idols and Kodimaram of Sri Periya Kaliyamman Kovil situated at Nilakkottai Taluk, Dindigul District for the festival to be conducted on 23.05.2023 by considering the petitioner's representation dated 20.02.2023.

¶3It appears that there is a dispute between two groups in the Chettiyar Community regarding offering worship in the petition mentioned temple. One group is led by Thiru.Kalidoss, while the other group is led by the petitioner. As per the decision taken in the Peace Committee Meeting, the group led by the petitioner had conducted the festival for the temple last year. Thereafter, on 19.06.2022, some persons of the village trespassed into the temple and taken away the Amman statue and Kodimaram belonging to the temple and handed over to the second respondent. Since the statue and kodimaram has been in custody of the second respondent, the public could not be able to worship and could not perform the pooja or festival. Hence, the petitioner made a representation to the respondents. Since there was no response, the present writ petition has been filed.

¶4The learned Government Advocate appearing for the respondents would vehemently submitted that because of two rival group, there is a possibility of law and order problem and hence, it may not be possible.

¶5Considering the facts and circumstances of the case, this Court directs the second respondent to conduct a peace committee meeting by giving notice to both the rival parties and take all efforts to install the statue and kodimaram at the earliest preferably, within a period of six weeks from the date of receipt of a copy of this order.

¶6With the above directions, this writ petition is allowed. No costs.
