Judgment
ORDER The present Contempt Petition has been filed alleging wilful disobedience of the order passed by this Court in W.P.(MD).No.5961 of 2026 dated 26.03.2026.
¶2The learned counsel appearing for the petitioner submitted that the petitioner is a woman entrepreneur. Though she originally belonged to the Most Backward Community (MBC), she subsequently married a person belonging to the Scheduled Caste (SC) community. Pursuant thereto, the Tahsildar issued a Scheduled Caste Community Certificate in favour of the petitioner. Based on the said certificate, the petitioner registered herself with TAHDCO and was awarded a service contract under the Scheduled Caste category. Subsequently, the respondents declined to execute/continue the agreement with the petitioner, compelling her to approach this Court by filing W.P.(MD).No.5961 of 2026. By order dated 26.03.2026, this Court issued appropriate directions to the respondents. According to the petitioner, the said directions have not been complied with, necessitating the filing of the present Contempt Petition.
¶3Per contra, the learned Standing Counsel appearing for the respondent submitted that, subsequent to the order dated 26.03.2026, the petitioner's contract came to be rejected, challenging which the petitioner filed W.P.(MD).Nos.9394 and 14258 of 2026. By a common order dated 08.07.2026, this Court issued appropriate directions permitting the petitioner to continue the work, subject to the outcome of the proceedings. It is further submitted that, thereafter, the District Level Scrutiny Committee, by proceedings dated 22.07.2026, cancelled the Scheduled Caste Community Certificate issued in favour of the petitioner.
¶4The learned counsel appearing for the petitioner fairly submitted that the District Level Scrutiny Committee has passed an order dated 22.07.2026 cancelling the Scheduled Caste Community Certificate issued to the petitioner.
¶5In view of the subsequent development, namely, the order passed by the District Level Scrutiny Committee on 22.07.2026 cancelling the Scheduled Caste Community Certificate granted in favour of the petitioner, this Court is of the view that the petitioner has to challenge the said proceedings in the manner known to law, if so advised. Liberty is granted to the petitioner to work out her remedy against the order of the Scrutiny Committee before the appropriate forum in accordance with law.
¶6In the light of the subsequent developments, this Court is of the opinion that no case of wilful disobedience of the order passed by this Court is made out against the respondent. Accordingly, the Contempt Petition cannot be proceeded with and hence, the Contempt Petition is closed.
