ORDER This petition has been filed seeking for a direction to the 1st respondent to afford police protection forbearing the respondents 3 to 9 from performing any rituals for the deity, Muthalamman of ArulMighu Muthulamman Temple on

04.06.2026 in the property comprised in S.No.432/1 (Old S.No.204/1), Melakottai Village, Thirumangalam Taluk, on the basis of the petitioner's representation dated 15.04.2026.

¶2The learned counsel appearing for the petitioner submitted that the subject property absolutely belongs to the petitioner. It was further submitted that Respondents 3 to 9 are proposing to conduct rituals and poojas relating to the subject temple in the petitioner's property on 10.06.2026. Apprehending interference with his peaceful possession and enjoyment of the property, the petitioner submitted a representation dated 15.04.2026 to the respondent police seeking necessary action and police protection to prevent Respondents 3 to 9 from conducting any such poojas or rituals in the petitioner's property. According to the petitioner, the said representation has not been considered thus far. Aggrieved by the same, the present writ petition has been filed.

¶3The learned Government Advocate appearing for the respondent police drew the attention of this Court to the representation dated 15.04.2026 submitted by the petitioner. He submitted that, under the said representation, the petitioner had sought necessary action against Respondents 3 to 9. However, without awaiting the outcome of the enquiry on the said representation, the petitioner has approached this Court seeking a direction for police protection. It was further submitted that the enquiry pursuant to the petitioner's representation is still pending consideration before the respondent police.

¶4Having regard to the nature of the order proposed to be passed in this writ petition, W.M.P.(MD) No.717 of 2026 seeking impleadment of the proposed respondents is allowed. The Registry is directed to carry out the necessary amendment in the cause title.

¶5Heard the learned counsel for the petitioner and perused the materials placed before this Court. Since no adverse order is proposed to be passed against the R10 to R16, notice to them is dispensed with.

¶6Considering the facts and circumstances of the case, the second respondent police are directed to issue notices to the petitioner as well as Respondents 2 to 16 under Section 64 of the BNSS and conduct an enquiry on

08.06.2026, after affording an opportunity of hearing to the petitioner and the private respondents. The enquiry shall be concluded on the same day and appropriate orders shall be passed in accordance with law. It is made clear that the Investigating Officer shall independently consider the matter and take a decision strictly in accordance with law, uninfluenced by any observations made in this order.

¶7With the above direction, this writ petition is disposed of. Consequently connected miscellaneous petition is closed.
