Chinnappan S v. The Superintending Engineer

ORDER This Writ Petition has been filed for issuance of Writ of Mandamus, directing the respondents to act upon the representations made by the petitioner, wherein the petitioner is seeking for shifting/removal of the electric poles and service lines from the property belonging to him.

¶2The case of the petitioner is that the subject property belongs to him and that electric poles have been erected and service connection has been given. The petitioner made representations in this regard and also undertook to incur the charges for shifting of the electric poles. The petitioner also deposited necessary amount. In spite of the same, no steps were taken to remove the electric poles. Aggrieved by the same, the present Writ Petition has been filed before this Court.

¶3Taking into consideration the facts and circumstances of the case and the nature of relief sought for by the petitioner, there shall be a direction to the third respondent to deal with the representations made by the petitioner on 21.12.2020 and 08.03.2021 and take a decision with regard to shifting/removal of the electric poles from the property belonging to the petitioner. This process shall be completed by the third respondent within a period of eight weeks from the date of receipt of a copy of this order.

¶4This Writ Petition is disposed of with the above direction. No costs.
