ORDER

This contempt petition has been filed alleging violation of the order dated 06.11.2025 passed in WP(MD)No.29940 of 2025, whereby this Court directed the respondents to release the eligible benefits to the petitioner together with interest at 6% in terms of the settlement entered into under 12/3 Industrial Dispute Act, 1947.

¶2When the matter is taken up for consideration, Mr.P.F.Ferlin Castro, learned counsel for the first respondent and Mr.S.C.Herold Singh, learned counsel for the second respondent submitted that the eligible amounts have been released in favour of the petitioner and accordingly, issued proceedings in bjh.jh.gp.Cont/2598/2026 dated 04.08.2026. It is further brought to the notice of this Court that the respondents have paid the eligible amounts Rs.10,60,851/- towards Commutation and Rs.1000/- towards Pongal Prize-2026, Rs.24,415/- towards 15th Wage Pension Arrear and Rs.89,111/- towards Commutation interest and accordingly, the respondents have complied with the order passed by this Court.

¶3However, the learned counsel for the petitioner disputes the same and contends that the petitioner is entitled for more amounts, but the respondents have not paid.

¶4As this Court while disposing of WP(MD)No.29940 of 2025 did not schedule the matter in detail and no specific amount was directed to be paid. The respondents claims to have paid the above amounts on finding that the petitioner is eligible only for the said amounts.

¶5In the circumstances, this Court does not see any reason to continue the contempt proceedings against the respondents and accordingly, the same is closed. However, it is made clear that in case if the petitioner is of the view that he is entitled for any some more amounts or the petitioner is aggrieved by the proceedings dated 04.08.2026, he is at liberty to take appropriate steps in accordance with law.
