ORDER This Civil Revision Petition has been filed by the petitioner to set aside the order passed in I.A.No.3 of 2020 in O.S.No.458 of 2014 dated 05.12.2022, on the file of the learned Additional District Munsif, Manapparai. By the impugned order dated 05.12.2022, the learned Additional District Munsif, Manapparai has rejected I.A.No.3 of 2020 filed by the petitioner in O.S.No.458 of 2014. I.A.No.3 of 2020 was filed by the petitioner to stay O.S.No.458 of 2014 in view of pendency of A.S.No.30 of 2020.

3.The petitioner is the plaintiff in O.S.No.458 of 2014 before the Additional District Munsif Court, Manapparai. The suit has been filed by the petitioner against the respondents herein for declaratory relief and for a permanent injunction. The respondents herein had earlier filed O.S.No.92 of 2013 before the District Munsif Court, Manapparai, which was decreed. It appears an appeal in A.S.No.30 of 2020 is pending before the Sub Court, Manapparai against judgment and decree passed in O.S.No.192 of 2013.

4.The specific case of the petitioner before the Additional District Munsif, Manapparai is that the subsequent suit filed by the petitioner in O.S.No.458 of 2014 for declaratory relief and permanent injunction has to be stayed in the light of the Section 10 of CPC. Therefore, the petitioner filed I.A.No.3 of 2020, was wrongly dismissed by the Additional District Munsif Court, vide impugned order dated

05.12.2022.

5.There is no basis on which the impugned order can be interfered with. The petitioner is the plaintiff in O.S.No.458 of 2015. It was open for the petitioner to have both the suits tried together. However, for unexplained reasons, they were neither tried or heard together. The earlier suit filed by the respondents appears to be decreed in favour of the respondents against which A.S.No.30 of 2020 is said to be pending. However, the petitioner is not a party to the said proceedings. Therefore, C.SARAVANAN

6.Considering the above, I find no reason to interfere in the impugned order. That apart the impugned order is well reasoned and does not call for interference.
