PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For anticipatory bail in Crime No.103 of 2023 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner/Accused who apprehends arrest at the hands of the respondent police for the offences punishable under sections 379 r/w.34 of IPC in Crime No. 103 of 2023 on the file of the respondent police, seeks anticipatory bail.

¶2The case of the prosecution is that on 01.06.2023 the defacto complainant along with her son and daughter-in-law came to the worship the temple and while they were on queue for annathanam five sovereigns of gold chain which belongs to the defacto complainant was found missing, hence the case.

¶3Heard both side and perused the materials available on record including the First Information Report.

¶4Taking into consideration of the facts and circumstances of the case and also the fact that the stolen property was not recovered, this court is not inclined to grant anticipatory bail to the petitioner.
