Judgment

ORDER The present Contempt Petition has been filed alleging violation of the orders of this Court dated 13.12.2024 made in W.P(MD) No.30280 of 2024, wherein, this Court has directed the writ petitioner to deposit a sum of Rs.50,000/- to the Provident Fund authorities and the petitioner was granted liberty to file a statutory appeal.

¶2It is alleged that even though the petitioner was ready to pay a sum of Rs.50,000/-, the Employee's Provident Fund Authorities have chosen to seize the bus of the petitioner roadways and hence the present Contempt Petition.

¶3According to the learned Standing Counsel appearing for the respondent, this Court has passed an order on 13.12.2024 directing the petitioner to deposit a sum of Rs.50,000/-. The petitioner has addressed a communication on 20.01.2025 seeking 60 days time to pay the sum of Rs.50,000/- and that request was acceded to. Thereafter, the petitioner has sent another communication on 28.03.2025 seeking a further period of 45 days, and that request was also acceded to. Thereafter, a recovery order was passed on 25.04.2025. On 06.05.2025, the petitioner has made another request for further time of 25 days for deposit of the amount i.e., on or before 30.05.2025. Since the undertaking was also not complied with, the impugned order was passed for seizure of the bus of the petitioner roadways on 03.06.2025. Hence, there was no extension of time on the part of the Employee's Provident Organization.

¶4Considering the submissions made on the side of the respondent authority, it is clear that they have not committed any contempt. However, it is the grievance of the petitioner that depending upon the bus they are earning their livelihood and they are ready to deposit the entire amount as per the order under Section 7A of the Employee's Provident Fund Act.

¶5In view of the above said submission, the authorities are directed to release the two wheeler as well as the bus that were seized by them, on deposit of a sum of Rs.1,05,000/- (Rupees One Lakh and Five Thousand only). Thereafter, the petitioner is at liberty to approach the appellate authority.

¶6With the above said observation, this Contempt Petition stands closed.
