Judgment

ORDER The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections of 296(b), 115(2), 351(2) BNS and Section 4 of the Tamil Nadu Prohibition of Harassment of Women Act in Crime No.212 of 2026 on the file of the respondent police, seek anticipatory bail.

2.The first petitioner is the husband of the defacto complainant. According to the prosecution, on

10.05.2026, due to the family dispute, the accused persons are said to have assaulted the defacto complainant and caused simple injury. Thereby, the respondent police registered a case for the aforesaid offences.

3.The learned counsel for the petitioners submitted that the petitioners are innocent persons and they have not committed any offences as alleged by the prosecution. He further submitted that there is already dispute between the first petitioner and the defacto complainant and they have already separated. Hence, he seeks anticipatory bail to the petitioners.

4.The learned Government Advocate (Criminal Side) opposed for grant of anticipatory bail to the petitioners on the ground that the accused persons have illegally trespassed into the house of the defacto complainant and assaulted her. However, he fairly conceded that there is no previous case pending against the petitioners.

5.This Court considered the rival submissions and perused the materials available on record.

6.Considering the facts and circumstances of the case and also considering the facts that there is no previous case pending against the petitioners and the nature of injury suffered by the defacto complainant is simple in nature, this Court is inclined to grant anticipatory bail to the petitioners, subject to certain conditions.
