ORDER This Civil Revision Petition has been filed by the petitioner to set aside the order passed in I.A.No.3 of 2022 in O.S.No.165 of 2022 dated

09.03.2023, on the file of the District Munsif Court, Sivagangai

2.The petitioner is the plaintiff in O.S.No.165 of 2022 before the District Munsif Court, Sivagangai. The suit has been filed by the petitioner for declaration of title and ownership in two patches of land approximately measuring 75 cents in Survey Nos.266/6B1 and 266/6B3. In the plaint filed in O.S.No.165 of 2022 in para no.4, the petitioner has stated that there is well situated, which is in the above two patches of land. The plaintiff has further claimed rights over the lands in the adjacent and contiguous region in Survey Nos.266/6A, 266/6B2, 266/8A, 266/8B. 3.Along with the plaint, the petitioner has also filed I.A.No.3 of 2022, wherein the petitioner has filed a petition under Order 26 Rule 9 of CPC for appointment of an Advocate Commissioner. The respondent has denied the existence of the well in the counter and the respondent also filed a written statement in the suit. 4.I have considered the arguments advanced by the learned counsel appearing for the petitioner and for the respondent.

5.The law in the subject is clear that the office of an Advocate Commissioner cannot be used for collecting evidence. At the same time, the Advocate Commissioner can be appointed to inspect the property and to give a report of physical features of the property and presence of well and its location.

6.In my view, the order of the learned District Munsif, Sivagangai rejecting the application was unwarranted as the respondent has denied the existence of the well in the counter.

7.Considering the above, I am inclined to allow this Civil Revision Petition by directing the District Munsif Court, Sivagangai to issue a warrant to an Advocate Commissioner to inspect the property and to give a report regarding the existence of the well in land in the suit schedule property.

8.Therefore, this Civil Revision Petition stands allowed. No Costs.
