Judgment
ORDER (Order of the Court was made by D.BHARATHA CHAKRAVARTHY, J.) The writ petition is filed for a mandamus directing the respondents 2 to 7 to ban the use of the loud speakers with high volume in large numbers for the Kumbabishekam to be conducted in respect of Arulmigu Rajaganapathi and Meenakshi Sundareswarar Temple located in Survey No.684/1 of Sevalur Village, Manapparai Taluk, Tiruchirappalli District, based on the petitioner's representation dated 15.05.2026.
¶2The learned counsel for the petitioner would submit that the temple itself is located on a water body and separate proceedings are taken in respect thereof. As far as the present petition is concerned, it is his case that when the Kumbabishekam is going to be celebrated between 23.05.2026 and 30.05.2026, number of loud speakers are being used and the noise levels are going beyond the permissible levels and therefore, the petitioner has made the representation.
¶3When the matter came up for admission, the learned Additional Public Prosecutor taking notice on behalf of the respondents 3 to 5, would submit that the 4th respondent would consider the petitioner's representation and pass orders in accordance with law.
¶4In view of the nature of order that is passed, the writ petition is disposed of at the admission stage.
¶5Since this Court is not expressing any opinion with reference to the merits of the averments that are made in the affidavit, notice is not issued to the private respondents 9 and 10. As far as Kumbabishekam is concerned, normally it will be celebrated by using the loud speakers in any temple. At the same time, if it is going beyond the permissible level and if there is high decibel noise, the same should not disturb the local public. In view thereof, the 4th respondent shall take up the representation of the petitioner dated 15.05.2026. The 4th respondent can inspect the place and ensure that the loud speakers / cone speakers are being used within the permissible noise level and not exceeding beyond the permissible decibel level.
¶6With the aforesaid direction, the Writ Petition stands disposed of. No costs. The authority is directed to act on the web copy of the order without waiting for the certified copy of the order. Consequently, connected miscellaneous petition is closed. [D.B.C., J.] & [R.P., J.] Index : No
