Judgment

ORDER The defacto complainant in CSR.No.207 of 2026 has come forward with this petition for cancellation of anticipatory bail granted to the respondents 2 to 4 herein in Crl.M.P.No.94 of 2026 on the file of the learned Vacation Sessions Judge, Pudukkottai, by order dated 20.05.2026.

¶2The learned counsel for the petitioner would submit that the petitioner has lodged a complaint against the respondents 2 to 4 for the offences under Section 85 of BNS and Section 4 of Dowry Prohibition Act. The same was under the enquiry before the respondent Police in CSR.No.207 of 2026 and apprehending arrest, the respondents 2 to 4 have approached the Sessions Court seeking anticipatory bail and the Sessions Court, after considering the allegations, granted anticipatory bail with certain conditions including that the respondents 2 to 4 shall appear before the Station House Officer of the respondent Police Station, daily at

10.30 a.m., for a period of 15 days and to co-operate with the investigation. It is now stated by the learned counsel that the respondents 2 to 4 have not complied with the aforesaid conditions and hence, prays to cancel the bail.

¶3Though notice has been served on the respondents 2 to 4 and their names are printed in the cause list, they have not come forward to either appear in person or represented through a counsel.

¶4The learned counsel for State (Crl. Side) appearing for the respondent Police submitted that since the complaint is in CSR stage and the respondents 2 to 4 have not come forward to comply with the order passed by the Sessions Court dated 20.05.2026, the respondent Police is not able to continue with the enquiry and hence, the same is pending.

¶5Heard both sides and perused the materials available on record.

¶6On careful perusal of the order passed by the Sessions Court, it is seen that the Sessions Court, by placing reliance on the observation made by the Apex Court in Shri Gurbaksh Singh Sibbia Vs. State of Punjab, AIR 1980 SC 1632 and by stating that since there is apprehension of arrest even in the stage of CSR enquiry, has agreed to grant anticipatory bail to the respondents 2 to 4 with certain conditions. However, now the respondents 2 to 4 have not complied with the conditions.

¶7In view of the submissions made by both sides and considering the fact that the respondents 2 to 4 have not complied with the bail conditions imposed on them and even after the time limit granted, the respondents 2 to 4 have not complied with the same and the Sessions Court has also categorically stated that the order would be cancelled if the respondents 2 to 4 have not surrendered before the concerned Court, it is a fit case for cancellation of bail. Accordingly, anticipatory bail granted to the respondents 2 to 4 in Crl.M.P.No.94 of 2026 on the file of the Vacation Sessions Judge, Pudukkottai, dated 20.05.2026, stands cancelled. The bail bonds, if any, executed by the respondents 2 to 4 before the concerned Court, are also hereby cancelled.

¶8Accordingly, this Criminal Original Petition is allowed. 15-07-2026 Lm To

1.The Vacation Sessions Judge, Pudukkottai.

2.The Inspector of Police, All Women Police Station, Alangudi, Pudukkottai District.
