Mamundi v. The Revenue Divisional Officer

O R D E R This Writ Petition has been filed for the issue of writ of mandamus directing the first respondent to take appropriate action to drain the water in S.F.Nos.286/6 and 286/1 in Thirunallur Village, Illuppur Taluk, Pudukkottai District, on the basis of the representation submitted by the petitioner dated 07.08.2020.

¶2The grievance expressed by the petitioner is that during the rainy season, rain water gets stagnated to the level of two feet from the ground level and it becomes difficult for the petitioner to dry the grains and store the grains.

¶3The learned Additional Government Pleader on instructions submitted that due to the difference in the level of the road, the rain water gets stagnated during the rainy season. In any case, the Revenue Divisional Officer does not have jurisdiction to deal with the relief that has been sought for by the petitioner in this Writ Petition.

¶4In the considered view of this Court, the stagnation of rainy water during the rainy season is a problem that is prevailing in all places, a solution cannot be find out by the Revenue Divisional Officer for this problem. The petitioner has to necessarily approach the local authority and seek for redressal of the grievance.

¶5Except giving this clarity, no further orders can be passed in this Writ Petition.

¶6This Writ Petition is disposed of with the above observations. No costs.
