Judgment
O RDER
This petition is filed seeking for a direction to the police not to harass the petitioner under the guise of enquiry.
2.It is submitted by the learned counsel for the petitioner that the petitioner has availed a loan of amount of Rs.7,00,000/- from the respondent No.2 and regularly has been paying the interest. However, on a false complaint given by the respondent No.2, the petitioner is harassing to pay an amount of Rs.14,00,000/-.
3.The learned Government Advocate (Crl.side) after getting instructions from the respondent No.2 police submits that on a complaint received from the respondent No.2, the police enquired with the petitioner, who has volunteered before the police that he would pay Rs.17,00,000/-, on which he has already paid an amount of Rs.3,00,000/ and in respect of the balance of Rs.14,00,000/-, the petitioner stated to have sought time and did not turn up and the date as agreed by the petitioner is coming closure, thereby this petition is filed.
4.It is also submitted that the police have never harassed the petitioner, as the issue between the petitioner and the respondent No.2 is purely civil in nature in respect of money transactions between them. If at all any issues are there in respect of money transactions, the aggrieved party is expected to go to the civil Court. However, in case if any criminal element emerges in the said monetary transactions, the aggrieved party can certainly approach the police. Since it is submitted that they have not harassed and forced the petitioner to pay, no further directions are required in this petition.
5.Accordingly, this Petition is closed. It is needless to state that the police are not required to intervene in the monetary transactions as long as any criminal element emerges.
