Counsel for State of TN (Crl.Side) PETITION FOR BAIL Under Sec.483 of BNSS PRAYER :- C-6B. For Bail in Crime No. 137 of 2026 on the file of the respondent police... ORDER : The Court made the following order :- The petitioner/A2, who was arrested and remanded to judicial custody on 29.04.2026, for the offences punishable under Sections 296(b), 115(2), 118(1) and 35(3) of BNS, 2023 @ Sections 296(b) and 103(1) of BNS, 2023, in Crime No.137 of 2026 on the file of the respondent Police, seeks bail.
¶2The allegation against the petitioner is that on 28.04.2026, the petitioner joined hands with other accused developed a quarrel with the deceased in a TASMAC bar and subsequently attacked the deceased indiscriminately with a beer bottle, causing multiple injuries on his body. Immediately thereafter, the deceased was taken to the Government Hospital, Virudhunagar, and was later referred to the Government Rajaji Hospital, Madurai, for further treatment. However, the deceased subsequently, died in the hospital on 02.05.2026. Hence, the case has been registered and the petitioner was arrested.
3.The learned counsel for the petitioner submitted that the petitioner is an innocent and a false case has been foisted against him, since he is having some previous cases. He is ready to cooperate with investigation. The petitioner has been arrested and remanded to judicial custody on 29.04.2026. Hence, he prays to grant bail to the petitioner.
¶4The learned counsel for State of TN (Crl. Side) appearing for the respondent submitted that the petitioner is ranked as A2 in this case, he was arrested on 29.04.2026. The FIR has been registered immediately on the date of occurrence and subsequently after the death of the deceased it was altered into the murder case. He further submitted that the petitioner is having seven previous cases and he is also a history sheeter. Hence, he strongly opposed to grant bail to the petitioner.
¶5Heard and Perused the materials available on record including the First Information Report.
¶6Considering the rival submissions made by the learned counsel on either side and the nature of offences levelled against the petitioner and considering the fact that the specific overt act attributed against the petitioner is that he attacked the deceased with beer bottle and also caused multiple injuries on the body and there is no ground for granting bail. Hence I am not inclined to consider the petition for grant of bail to the petitioner.
¶7Accordingly, this Criminal Original Petition stands dismissed.
