Judgment

O R D E R This Criminal Original Petition is filed seeking quashment of the FIR in Crime No.285 of 2022 on the file of the first respondent Police which is registered for the offence under Sections 420, 468, 471 and 472 IPC.

¶2When the matter is taken up for hearing, the learned Additional Public Prosecutor appearing for the first respondent Police submits that the Police have sent the admitted signature of the Village Administrative Officer and the disputed signature to the Handwriting Expert and the report is awaited. Once the report is received, the first respondent Police will file the final report under Section 173 Cr.P.C.

¶3The issue with regard to the allegations made against the petitioner that the petitioners have committed forgery of signature and tampered the seal of the office of the Village Administrative Officer, cannot be decided unless the investigation is completed. Therefore, the request of the petitioners for quashing of FIR cannot be considered at this stage. Since the investigation is substantially completed, this petition is therefore dismissed directing the respondent Police to complete the investigation as expeditiously as possible not later than two months from the date of receipt of a copy of this order and in case the Police file the charge sheet, the petitioners are at liberty to challenge the same. Connected miscellaneous petition is closed.
