Judgment

O R D E R This Criminal Original Petition is filed seeking for a direction to the second respondent Police not to harass the petitioner and his family members asking them to withdraw a complaint given by the petitioner against her neighbors.

¶2It is submitted by the learned counsel appearing for the petitioner that on 19.06.2023, a lorry carrying sand has stopped in a narrow line and hit the fence of compound, due to which, altercation took place and the neighbors have assaulted the petitioner, and the petitioner has received injuries. In this regard, she has given a complaint before the respondent Police to take action against her neighbors. The Police have registered as C.S.R.No.226 of 2023, but no action was taken. On the other hand, the respondent Police are pressuring the petitioner to withdraw the complaint given by her.

¶3The learned Government Advocate (criminal side) appearing for the respondents Police would submit that basing on the complaint given by the petitioner, initially C.S.R.No.226 of 2023 has been given and subsequently, a case in Crime No.338 of 2023 was registered on

04.07.2023 for the offence under Sections 147, 294(b), 323 and 506(1) IPC and the investigation has been undertaken. It is also submitted that on a complaint given by the neighbors against the petitioner, a case has been registered against the petitioner in Crime No.337 of 2023 on the same day for the offence under Sections 294(b), 352 and 506(1) IPC. The Police have called the petitioner for enquiry on the complaint given by the neighbors.

¶4Since the FIR has already been registered basing on the complaint given by the petitioner and the Police have called the petitioner only for enquiry on the complaint given by her neighbors, no further order is required to be passed in this petition. Accordingly, this Criminal Original Petition is dismissed.
