Judgment

ORDER The petitioner apprehends arrest for the alleged offence under Section 296(b), 126(2), 103(1) and 303(2) of BNS in Crime No.221 of 2026, on the file of the respondent Police seeks anticipatory bail.

¶2The allegation against the petitioner is that the petitioner is arrayed as A8 and it is stated that the deceased Badhusha, had an extra-marital relationship with A1's sister and due to that enmity, A1 and the other accused persons confronted and committed the murder of the deceased Badhusha. It is alleged that this petitioner assisted the other accused by supplying the weapons.

¶3The learned counsel for the petitioner submitted that the petitioner has been falsely implicated in this case, since he has three previous cases and the petitioner is working at Pudukkottai and there are no materials to establish the petitioner's presence at the place of occurrence. Hence, he prayed to grant anticipatory bail to the petitioner.

¶4The learned Counsel for State of TN (Crl.Side), appearing for the respondent Police, reiterated the prosecution case and submitted that, on the basis of the confession of the co-accused, the role of the petitioner was revealed and it was found that he had informed the other accused that if A1 did not take any steps to get rid of the deceased, there was a likelihood of the deceased murdering A1, and that he handed over the patta knife. Hence, he opposed the grant of anticipatory bail to the petitioner.

¶5Heard the learned counsel for the petitioner and the learned Counsel for State of TN (Crl.Side) for the respondent.

¶6Considering the fact that based on the FIR, the connected materials and the confession of A1, it revealed that the petitioner supplied the weapons and also instigated A1 to commit the murder of the deceased and he involved in three previous cases, most of which are for an offence under Section 506(ii) of IPC and the confessions of the arrested accused reveal that they independently decided to get rid of the deceased and after some time, informed the same to the petitioner herein, upon which the petitioner supplied the knife. Hence, I am inclined to grant anticipatory bail to the petitioner, subject to the following conditions: [a] Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on their appearance, within a period of fifteen days from the date on which the order copy made ready, before the learned Judicial Magistrate No.VI, Trichy, on condition that the petitioner shall execute a bond for a sum of Rs. 20,000/- (Rupees Twenty Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate concerned and on further conditions that: [b] the petitioner shall report before the respondent police daily at 10.30 a.m., for a period of four weeks and thereafter as and when required for the interrogation. [c] the petitioner shall not commit any offences of similar nature. [d] the petitioner shall not abscond either during investigation or trial. [e] the petitioners shall not tamper with evidence or witness either during investigation or trial. [f] On breach of any of the aforesaid conditions, the learned Judicial Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560]. [g] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 B.N.S.
