Judgment

O R D E R This writ petition has been filed seeking a writ of mandamus directing the respondents 1 to 3 to include the name of the petitioner in the panel for promotion to the post of Nursing Tutor Grade-II and to direct the respondents 1 to 3 to promote her to the said post.

¶2This matter earlier came up for consideration on 19.06.2026 and this Court, after having heard the learned counsel for the petitioner, passed the following order: "Mrs.K.Porkodi, learned counsel for the Government, takes notice for the respondents and seeks time to get instructions as to why the case of the petitioner is not being considered for promotion to the post of Nursing Tutor Grade-II.

¶2List the matter on 29.06.2026 in the admission list."

¶3Today, when the matter is taken up for further consideration, Mr.C.Jeganathan, learned counsel for the Government of Tamil Nadu appearing for the respondents, on instructions, submitted that the case of the petitioner could not be considered for promotion to the post of Nursing Tutor Grade-II for the panel year 2025-2026, as she was found not eligible for consideration for inclusion of her name for the said panel year as she suffered a punishment of censure vide proceedings dated 22.06.2024 issued by the second respondent and the said punishment was in operation as on the crucial date. He also, on instructions, further submitted that the case of the petitioner would be considered for promotion to the post of Nursing Tutor Grade-II during the panel year 2026-2027 subject to her eligibility and zone of consideration etc.

¶4In the light of the above, this Court does not see any reason to invite counter-affidavit from the respondents and accordingly, this writ petition is disposed of directing the respondents to consider the case of the petitioner for promotion to the post of Nursing Tutor Grade-II during the panel year 2026-2027, subject to her eligibility and on she satisfying the other requirements, along with the other eligible candidates. No costs. Consequently, connected miscellaneous petition is closed.
