Judgment
ORDER The petitioner is before this Court challenging the impugned Refusal Check Slip dated 07.04.2026 issued by the respondent, whereby the respondent declined to register the Lease Deed dated 07.04.2026 executed by the petitioner in favour of one of its Trustees.
¶2It appears that proceedings were initiated against the petitioner under Section 33-A of the Indian Stamp Act, 1899, culminating in an order dated 28.08.2020 passed by the District Registrar in Proceedings No.4583/Aa1/2019. Aggrieved by the said order, the petitioner preferred a statutory appeal before the Inspector General of Registration, who, by order dated 27.11.2024 in Proceedings No.Pa.Mu.No.34583/PP1/2020, dismissed the appeal.
¶3Aggrieved by the aforesaid appellate order, the petitioner has filed W.P.No.8967 of 2025 before the Principal Seat of this Court at Chennai. By order dated 20.03.2025, the Principal Seat granted an interim order of stay. Therefore, the correctness of the orders passed by the District Registrar and the Inspector General of Registration, referred to above, is still under consideration, and the Principal Seat of this Court is presently seized of the matter. ¶4The records further reveal that the petitioner had taken over the assets of Sri Bharathi Educational Trust under a Deed of Declaration of Trust dated 29.01.2018, which was registered as Document No.295 of 2018. In the said document, the value of the assets taken over by the petitioner Trust was declared at Rs.2,95,36,114/-, whereas the petitioner paid only a sum of Rs.1,200/- towards stamp duty together with 1% towards registration charges. Consequently, proceedings under Section 33-A of the Indian Stamp Act, 1899, came to be initiated.
¶5Having considered the submissions made by the learned counsel for the petitioner and the learned Standing Counsel for the respondents, this Court is inclined to dispose of the writ petition by directing the respondent to register the Lease Deed dated 07.04.2026, subject to the condition that the petitioner shall not alienate the subject property or create any third-party rights in respect thereof, pending further orders to be passed by the Principal Seat of this Court in W.P.No.8967 of 2025.
¶6The Writ Petition stands disposed of accordingly. No costs. NCC : Yes / No
