Anantharaj, No.4, Mahalakshmi Nagar, 3rd Street,Wireless Road, K.K.Nagar, Trichy District.. ... Petitioner/Accused No.5 Vs State of Tamilnadu Rep by, The Inspector of Police, Airport Police Station, Trichy City, Trichy District. (Crime No. 83 of 2026). ... Respondent/Complainant For Petitioner : Mr.K.Dinesh, Advocate. For Respondent : Mr.N.Balasubramanian, Counsel for State of TN (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.482 of BNSS PRAYER :- C-8AB. For Anticipatory Bail in Crime No. 83 of 2026 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner/Accused No.5, who apprehends arrest at the hands of the respondent police for the offences under Sections 191(2), 191(3), 126(1), 296(b), 115(1), 118(1), 351(3) and 109(1) of BNS, 2023, in Crime No.83 of 2026, on the file of the respondent Police, seeks anticipatory bail.

.The allegation against the petitioner is that the petitioner is ranked as A5 in this case. It is alleged that due to quarrel between A1, A2 and the injured in this case, the accused waylaid and attacked him with patta knife adn casued injuries to him. Hence, the present complaint has been registered.

.The learned counsel appearing for the petitioner submitted that the only allegation against the petitioner is that he went to the place of occurrence as per the request of the other accused and he was not aware that the other accused on the other hand, attacked the defacto complainant. He further submitted that the petitioner is not having any previous case and he is ready to cooperte with the investigation, Hence, he prayed to grant anticipatory bail to the petitioner.

.The learned Counsel for the State of TN (Crl. Side) appearing for the respondent Police reiterated the prosecution case submitted that the petitioner is not having any previous cases. He further submitted that the injured is still undergoing treatment for his head injury. Hence, he opposed to grant anticipatory bail to the petitioner.

.I have heard the learned counsel on either sides and also gone through the FIR and the other connected materials.

.Admittedly, there is no overt act attributed against the petitioner herein and the defacto complainant was attacked by the other accused and not by this petitioner. However, it is stated that the petitioner also accompanied them to attack the defacto complainant.

.Considering the above facts and circumstances of the case and though it is stated that the injured is still undergoing treatment, considering the overt act attributed against the petitioner and the petitioner has no previous cases, this Court is inclined to grant anticipatory bail to the petitioner subject to certain conditions. [a] Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance, within a period of fifteen days from the date on which the order copy made ready, before the learned Judicial Magistrate Court No.VI, Trichy, on condition that the petitioner shall execute a bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate concerned and on further conditions that: [b] the petitioner shall report before the respondent police daily at 10.30 a.m., for a period of three weeks and thereafter, as and when required for interrogation. [c] the petitioner shall not commit any offences of similar nature. [d] the petitioner shall not abscond either during investigation or trial. [e] the petitioner shall not tamper with evidence or witness either during investigation or trial. [f] On breach of any of the aforesaid conditions, the learned Judicial Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560]. [g] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 B.N.S.
