BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT ( Criminal Jurisdiction ) Date : 25/07/2023 PRESENT The Hon`ble Mr.Justice G.ILANGOVAN

¶1J.Ragul

¶2Kabilan ... Petitioners / Accused Nos.3 and 4 Vs The State rep by The Inspector of Police, Nadukaveri Police Station, Thanjavur District. (Crime No.148 of 2023.) ... Respondent / Complainant For Petitioners : Mr.R.L.Dhilipan Pandian, Advocate For Respondent : Mr.B.Nambiselvan,

Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.148 of 2023 on the file of the respondent police. ORDER : The Court made the following order :- The petitioners/A3 to A4, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 147, 148, 294(b), 323, 324, 506(ii) and 307 of I.P.C., in Crime No.148 of 2023 on the file of the respondent police, seek anticipatory bail.

2.The earlier anticipatory bail petition filed by the petitioners was dismissed by this Court on 30.06.2023, since the injured was taking treatment. The petitioners again approached this Court by filing this petition seeking anticipatory bail, on the ground that injured has been discharged from the hospital and co-accused was granted regular bail.

3.In response, the learned Additional Public Prosecutor produced the photographs showing the nature of injuries sustained by the injured and prays to dismiss the petition.

4.On perusing the photographs produced by the learned Additional Public Prosecutor, it is seen that the injured was brutally assaulted by the accused persons. Considering the gravity of offence and nature of injuries sustained by the injured, this Court had dismissed the earlier petition. This Court finds no change in circumstances to enlarge the petitioners on anticipatory bail, though the injured has been discharged from the hospital.

5.Accordingly, this Criminal Original Petition stands dismissed.
