Dhanabal Ari v. The Immigration Officer

ORDER This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the respondents Nos.1 to 3 to return the original passport to the petitioner.

¶2Heard Mr.R.Senthilkumar, learned counsel appearing for the petitioner, and Mr.Nandhakumar, learned Central Government Standing Counsel, who accepts notice on behalf of the respondent Nos.1 to 3 and Mr.R.Mohamed Riyaz, learned Government Advocate (Criminal Side) takes notice for respondent Nos.4 and 5.

¶3By consent of both parties, the Writ Petition is taken up for final disposal at the stage of admission itself.

¶4The learned counsel appearing for the petitioner submitted that the first respondent received the petitioner's passport on 14.05.2025. However, the first respondent has not returned the passport to the petitioner till date. Therefore, the petitioner made a representation to the respondents on 10.06.2026. Since no action has been taken by the respondents, the petitioner has filed the present writ petition. `5. The learned Central Government Standing Counsel appearing for the respondent Nos.1 to 3 submitted that the petitioner's representation would be considered in accordance with law.

¶6In view of the above submission, this Writ Petition is disposed of with a direction to the respondent Nos.1 to 3 to consider the petitioner's representation dated 10.06.2026 and pass appropriate orders on merits and in accordance with law within a period of four (4) weeks from the date of receipt of a copy of this order. No costs.
