Judgment
ORDER This petition is filed seeking for a direction to the respondent police to grant the permission and necessary protection to conduct Kabadi Tournament on
29.07.2023 and 30.07.2023 in Kalvoy Village, Thoothukudi District.
2.It is submitted by the learned counsel that the petitioner has been conducting the kabadi tournament for the last 15 years and this year also, the villagers have made all the arrangements to conduct the kabadi tournament peacefully and that no untoward incident happened earlier and that the programme was conducted smoothly.
3.The learned Government Advocate (Crl.side) on the other hand submits that basing on a report of the Inspector of Police, Seidunganallur Police Station, Thoothukudi District dated 25.07.2023, there is a possibility of communal clash in the village, thereby the permission could not be given to the petitioner to conduct the programme.
4.Since the police suspect that there could be law and order problem on account of the communal clash, the request of the petitioner to direct the respondent police to grant permission to the petitioner for conducting the kabadi tournament on 29.07.2023 and 30.07.2023 at Kalvoy Village, Thoothukudi District cannot be granted.
5.However, the petitioner is directed to approach the respondent police and file fresh application afresh, on which the police are directed to make thorough enquiry with all sections of people and in case if the situation is improved and congenial for conducting the tournament, necessary permission may be granted subject to the guidelines issued vide proceedings in Rc.007301/Genl.I(1)/2019 dated 09.04.2019 by the Director General of Police, Tamil nadu. Accordingly, this Writ Petition is disposed of. No costs.
