O R D E R The present Civil Revision Petition has been filed by the petitioner under Article 227 of the Constitution of India, against the fair and decreetal order dated 21.08.2018 in I.A.No.139 of 2016 in unnumbered A.S.No.Nil of 2016 on the file of the Sub Court, Thoothukudi.

¶2When the matter is taken up for hearing, the learned counsel appearing for the petitioner would submit that the application has been filed against the dismissal order passed in delay condonation application where he prayed to condone the delay of 1789 days. He would further submit that the petitioner died and the respondent is his wife. It is the submission of the learned counsel for the petitioner, that after demise of the petitioner, no one has approached. Hence, he prayed to dismiss the petition as abated.

¶3In the result, this Civil Revision Petition is dismissed as abated. There shall be no order as to costs. Consequently connected Miscellaneous Petition is closed.
