Judgment

ORDER (Order of the Court was made by A.D.JAGADISH CHANDIRA,J.) This Writ Petition has been filed for a direction to direct the respondents to provide proper and specialized medical treatment to the petitioner's husband in a suitable Government Super Speciality Hospital and if such treatment is not available therein, to permit to give treatment in a recognized private hospital at the cost of the petitioner's husband by considering the petitioner's representation dated 18.06.2026.

¶2Heard the learned counsel for the petitioner and the learned Counsel for State of TN (Crl.Side) appearing for the respondents.

¶3The case of the petitioner is that her husband, who is detained as a Goonda in Central Prison, Palayamkottai, is suffering from Disseminated Tuberculosis (DTB), a severe and life-threatening form of tuberculosis affecting multiple organs and that the petitioner came to know that her husband was suffering from weight loss of about 20 kgs. The petitioner had sent a representation seeking treatment for her husband in a private hospital and since the representation was not considered, the petitioner has come up with this petition.

¶4When the matter was taken up for hearing today, the learned Counsel for State of TN (Crl.Side) would submit that the petitioner's husband was confined in Central Prison, Palayamkottai on 27.03.2026 and before being confined, he was seen by a specialist at Tirunelveli Medical College Hospital and DAP opinion was obtained. He was diagnosed as an old case of disseminated tuberculosis, completed ATT and a known case of SHT/DM on treatment and was prescribed regular oral medications. He would further submit that after being admitted in Central Prison, Palayamkottai, the petitioner's husband was kept in the Central Prison dispensary and his blood sugar level and blood pressure were monitored and he was given regular anti-hypertensive and anti-diabetic drugs. Since the prisoner was not willing to stay in the hospital, he was discharged at his request and given anti-diabetic drugs and anti-hypertensive drugs on a weekly basis and was advised to continue oral medication regularly. He has also been given an anti-diabetic diet and in support of the above submission, he produced the certificate issued by the Medical Officer, Central Prison, Palayamkottai, on 24.06.2026. He would further submit that at present, the health condition of the petitioner's husband is stable and does not require any treatment in a private hospital.

¶5Taking into consideration the facts and circumstances of this case and considering the medical certificate issued by the prison hospital and also considering that the health condition of the petitioner's husband is stable and he does not require any treatment in a private hospital, this Writ Petition stands closed. No costs. (A.D.J.C.,J.,) (R.P.,J.,)
