Case no.
WP(MD) 18760/2023

Judgment

O R D E R [Order of the Court was made by D.BHARATHA CHAKRAVARTHY, J.] This writ petition is filed challenging the demand notice, dated

18.05.2023, said to have been published by the respondent – Bank in New Indian Express.

¶2A perusal of the impugned notice shows that it is only a demand notice issued under Section 13(2) of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 calling upon the borrowers to repay the amounts due together with interest thereof, within a period of 60 days from the date of publication of the notice.

¶3This Court finds that this writ petition itself is misconceived and it has been filed as if the impugned notice is a sale notice. Hence, this writ petition is dismissed with liberty to the petitioner to approach the respondent – Bank by submitting a representation, if he chooses to do so. No costs. Consequently, connected miscellaneous petitions are closed.
