Nagaraj.K v. The District Collector

¶2The petitioner espouses the cause of a temple. According to the petitioner, the temple was put up some 40 years ago. We made it clear that if the temple had been in existence as on 15th August 1947, it would be entitled to statutory protection. Since even according to the petitioner it was put up some 40 years ago, it would not have statutory protection. The learned counsel appearing for the petitioner states that it was put up on natham land and not on water-body. 3 W.P.(MD)NO.18552 OF 2023

¶3We direct the third respondent to conduct proper survey after issuance of notice to the petitioner herein. If the temple is on a natham land, it would be spared. If the temple is on the water-body, it will have to be demolished. The entire exercise will be completed within a period of three months from the date of receipt of a copy of this order.
