Judgment

O R D E R The present Writ Petition has been filed seeking to quash the impugned order passed by the first respondent in Pa.Mu.C4/2545/2026 dated 26.05.2026.

2.Learned Counsel appearing for the petitioner would submit that the petitioner is the son of the respondents 3 & 4. The respondents 3 & 4 made a complaint before the second respondent, alleging that the petitioner was residing along with the respondents 3 & 4 and thereafter, the petitioner chased away them from their house. The second respondent through its order dated 03.02.2022 recovered possession from the petitioner and handed over it to the respondents 3 & 4. Aggrieved over the same, the petitioner filed an appeal before the first respondent and the first respondent vide the impugned order dated 26.05.2026, confirmed the order of the second respondent. As against the concurrent findings, the present Writ Petition has been filed.

3.Today, the petitioner and the respondents 3 & 4 have appeared in person before this Court. The petitioner / son would submit that the petitioner will vacate the premises within a period of four [4] months from today [02.07.2026] and hand over the same to the respondents 3 & 4 and prays that this Court may issue a direction to the respondents 3 & 4 not to alienate or encumber the property till their life time. The respondents 3 & 4 who appeared before this Court would submit that the disputed property is an ancestral property owned by the third respondent's father and subsequently, patta was transferred in the name of the third respondent. However, they do not have any intention to alienate or encumber the property till their life time. Accordingly, they pray for appropriate orders.

4.In view of the consent view expressed by the petitioner as well as the respondents 3 and 4, this Writ Petition is disposed of, on the following terms:

i) the petitioner is directed to vacate and hand over possession of the subject property within a period of four [4] months from today [ie., on or before 02.11.2026], failing which the local jurisdictional police is directed to vacate the petitioner and hand over possession to the respondents 3 & 4;

ii) the respondents 3 & 4 are directed not to alienate or encumber the disputed property till their life time. After their life time, if necessary liberty is granted to the petitioner to approach the competent Civil Court and the petitioner is entitled to claim a share in all the ancestral properties, in the manner known to law. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
