Judgment

O R D E R Heard the learned counsel appearing for the petitioner and the learned Special Government Pleader appearing for the official respondents. 3 W.P.(MD)NO.18653 OF 2023

¶2The petitioner wants this Court to direct the fourth respondent to clear the encroachments committed by the seventh respondent on the petition-mentioned water-body.

3.When the matter was taken up for hearing, the learned Special Government Pleader submitted that the final order under Section 6 of the Tamil Nadu Land Encroachment Act had already been passed by the fourth respondent. The encroacher filed an appeal before the District Collector and the same was also dismissed on 27.04.2023. Challenging the same, the encroacher moved the Additional Chief Secretary, Revenue and Disaster Management Department, Government of Tamil Nadu by way of revision.

¶4Even though the said revisional authority is not before this Court, we direct the revisional authority to dispose of the revision on merits and in accordance with law within a period of three months from the date of receipt of a copy of this order. Based on the outcome of the said revision, consequential action has to necessarily follow. The revisional 4 W.P.(MD)NO.18653 OF 2023 authority should not seek extension of time. The first respondent shall inform the revisional authority about the passing of this order. This writ petition stands disposed of. No costs.
