Judgment

ORDER (Order of the court was made by C.V.KARTHIKEYAN, J.) The writ petition had been filed in the nature of a mandamus seeking a direction against the respondents particularly Tamil Nadu Power Distribution Corporation Limited from installing or construction electrical sub station in S.No.38A/2A of Veppankulam Village. The said land belonging to the 6th respondent/Arulmigu Muthu Mariamman Thirukovil and Ayyanar Thirukoil, Veppankulam, which is administered by the HR&CE Department at Pattukottai in Thanjavur District.

¶2It is contended that the said land is used during festival season for performing the religious rights and rituals and also as market place. It is contended that if in that particular place, an electrical sub station is constructed, then, it would cause much hardship and it would be dangerous to the general public. It is further stated that the 6th respondent had initiated a scheme called "Oorukku oru vanam" (one village one forest) scheme and in the said lands coconut trees, palm trees more than 100 teak wood trees, guava trees and several other indigenous species up to 2000 varieties of trees and plants are being planted.

¶3Notice had been directed to the respondents and today we are presented with the communication from the Assistant Executive Engineer at Madhukkoor, who had very categorically stated that in view of the objections raised, the proposal to install sub station in S.No.38A/2A of Veppankulam Vilalge had been dropped.

¶4We record the said statement. However, we would only express our views that the installation of an electric sub station is required for the general public and if any alternate conducive place is available, the District Collector, Thanjavur may allot the same for construction of electrical sub station for the general public in Veppankulam Village and in neighbouring villages. The writ petition stands disposed of accordingly. No costs. Consequently connected Miscellaneous Petition is closed.
