Judgment

ORDER (Order of the Court was made by C.V.Karthikeyan, J.) This writ petition has been filed in the nature of Certiorari to call for the records relating to the order of the learned Chief Judicial Magistrate, Trichy in Crl.M.P.No.2172 of 2025 dated 05.06.2026 and quash the same.

2.The employer/associate or somebody who knows the sister of the accused has been categorized as the second accused in a prosecution launched by CBI. The accused No.1 & 3 were officials of the respondent Bank. The said prosecution related to furnishing of document to obtain loan to the value of Rs.5 Crores from the respondent herein. The trial Court had convicted all the three accused. This Court, in appeal, had confirmed the same. The petitioner claims innocence and ignorance of all those transaction and seeks indulgence of this Court.

3.On the side of the respondent, it is contended that sale certificate of the property had also been issued. The auction purchasor had obtained a valuable right. The sale notice had not been challenged by the petitioner. The father of the petitioner had challenged the sale notice by filing S.A.No.299 of 2011 and the same had also been dismissed on

25.04.2024. After exhausting all those remedies, one by one, the family members are approaching the Court. This writ petition is extremely vexatious.

4.The Hon'ble Suprme Court in T.Arivandandam Vs. T.V. Satyapal and another, reported in 1977 AIR 2421, had commented upon vexatious litigation, more particularly, re-litigation and re-agitation of the same issues. In that particular case, an eviction order had been passed against the father. The matter had travelled upto Hon'ble Supreme Court. It was confirmed and thereafter, the son again filed a suit and the Hon'ble Supreme Court had said that such litigation should be nipped in the bud.

5.In the case on hand, the respondent had initiated action under SARFAESI Act and matters are pending before the competent Court. The present writ petition has no nexus to stand. We are not inclined to entertain this writ petition.

6.In the result, the writ petition stands dismissed. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed. [C.V.K., J.] & [R.S.V., J.] NCC : Yes/No 30.06.2026 Index : Yes/No Internet:Yes/No gns To The Chief Judicial Magistrate, Trichy.
