ORDER Heard the learned counsel for the writ petitioner, the learned Government Advocate for the official respondents and the learned counsel for the impleaded respondent.
2.The prayer in the writ petition is for removal of encroachment made by the private respondents in the petition mentioned water bodies.
3.In our view, no exception can be taken to the said request.
4.However, the Executive Engineer, Public Works Department / WRD in his status report has pleaded certain practical difficulties. 16.11.2023 from 09.00 am onwards. We direct that the concerned officials in PWD / WRD as well as Highways department should not only be present but also to extend their fullest cooperation. Notice shall be issued to all the encroachers also. Survey report along with survey sketch shall be made ready within a period of two weeks thereafter. Based on the same, the respective authorities namely, the Assistant Engineer, WRD, the Tahsildar as well as the impleaded 27th respondent are directed to invoke the powers conferred on them by the respective statues so as to clear the encroachments coming under their respective control.
