4.The refusal check slip is on the strength of Section 22A of the Registration Act, 1908, as inserted by Tamil Nadu Act 28 of 2012, dated

21.06.2012 with effect from 20.10.2016. The sale will be hit by the rigors of Section 22A(2) of the Registration Act, 1908. However, taking note of the constitutional right under Article 300A of the Constitution of India, this Court has come to the rescue of persons, like the petitioner in Ramaprabha Vs. The Sub Registrar, Kottaram Sub Registrar Office, Kanyakumari District, W.P.(MD) No.14197 of 2026, dated 21.05.2026.

5.The impugned refusal check slip is quashed subject to the buyer, namely, Vasanthi, giving an undertaking to the second respondent that the land purchased from the petitioner will not be used for housing or commercial purposes, unless appropriate regularization is obtained from the competent authority as has been ordered by this Court in Ramaprabha's case (referred supra).

6.Subject to the buyer giving an affidavit to that effect, the registration shall be completed for the document presented on 18.06.2026 as expeditiously as possible.

7.The Writ Petition stands disposed of, accordingly. No costs. Consequently, connected Miscellaneous Petition is closed. Index :
