Judgment
O R D E R The petitioner is before this Court challenging the impugned Refusal Check Slip dated 26.05.2026 issued by the second respondent bearing Refusal No.RFL/Gujiliyamparai/25/2026 dated 26.05.2026.
¶2By the impugned Refusal Check Slip, the second respondent has declined to register the Settlement Deed dated 26.05.2026 presented by the petitioner, proposing to settle an extent of 4 cents of land in Survey No.1703/7B3. The reasons assigned in the impugned Refusal Check Slip are extracted hereunder: "Kjd;ik khtl;l cupikapay; ePjpkd;wk;> Ntlre;J}u; Kjd;ik khtl;l cupikapay; ePjpgjp mtu;fshy; toq;fg;gl;l mry; tof;F vz;.113/2003 ehs; 20.12.2024 d;gb jpU.fy;ahzRe;juk; (thjp) kw;Wk; 18 egu;fs; tof;F njhlug;gl;L jPu;g;ghiz ngwg;gl;Ls;sJ. jPu;g;ghizapy; gf;fk; 16y; 1-k; gpujpthjpapd; kfDk; Nru;e;J Nkhrbahf jhth nrhj;ij nghJg;ghij vd fhl;b fle;j 23.01.2015-Mk; Njjp th.rh.M.6 guptu;j;jid gj;jpuk; Vw;gLj;jpf; nfhz;ljhf $wp> 2 Kjy; 5 thjpfs; 11 Kjy; 14 gpujpthjpfshf khw;wk; nra;ag;gl;Ls;sJ njupa tUfpwJ. tof;F epYitapy; ,Ue;j rkaj;jpy; ePjpkd;w mDkjpapd;wp> jug;gpdu;fshy; th.rh.M.6 Vw;gLj;jg;gl;Ls;sjhy;> nrhj;J gupkhw;w rl;lk;> 1882 gpupT 52-d;gb jhth nrhj;ij nghWj;J Vw;gLj;jg;gl;Ls;s th.rh.M.6 Page No. 2 of 6 Mtzk; thjpia fl;Lg;gLj;jhJ. ¶3It is noticed that the petitioner is the first defendant in O.S.No. 113 of 2003. The said suit has been filed for partition of the property in Survey No.1703/8. During the pendency of the said suit, an Exchange Deed dated 23.01.2015, registered as Document No.128 of 2015, was executed between the petitioner, and one K.Selvaraj, for himself and on behalf of his minor son, Muralitharan, and the petitioner's son, K.Raghupathi, and R.Poochinayackar, and A.Kumar, for himself and on Page No. 3 of 6 behalf of his minor children, K.Rangasamy and K.Sakthivel, and A.Karuppasamy. The said Exchange Deed itself is based on the Partition Deed dated 16.07.1990 registered as Document No.423 of 1990. However, it is noticed that the Trial Court, in its judgment dated
20.12.2024 in O.S.No.113 of 2003, has recorded as under: "21.gpujpthjpfs; $wpathW jhth nrhj;J nghJg; ghijahf ,Ue;jpUe;jhy;> tUtha; Jiw Mtzq;fspy; ru;Nt vz; 1703/8 vd;gJ ghij vd tifg;gLj;jg;gl;bUf;Fk;. Nkw;gb Mtzk; rl;lg;gb nry;yj;jf;fjy;y vd;Wk; ,e;ePjpkd;wk; KbT nra;fpwJ."
¶4The impugned Refusal Check Slip itself records that an appeal is pending before the appellate Court in A.S.No.10 of 2025. Considering the fact that the said Exchange Deed dated 23.01.2015 has been declared null Page No. 4 of 6 and void by the Trial Court in its Judgment and Decree dated 20.12.2024 in O.S.No.113 of 2003, against which the aforesaid appeal is pending, the request of the petitioner for registration of the Settlement Deed dated
26.05.2026, based on the said Exchange Deed dated 23.01.2015 declared as null and void, cannot be countenanced. Consequently, the impugned Refusal Check Slip cannot be interfered with or quashed pending the orders of the appellate Court in A.S.No.10 of 2025.
¶5Therefore, this Writ Petition is dismissed with liberty to the petitioner to approach the second respondent once again in case the petitioner secures a favourable judgment in the appeal. There shall be no order as to costs.
