Judgment

ORDER This Writ Petition is filed seeking to issue Writ of Mandamus directing the respondents more particularly the second respondent to consider the petitioner's representation dated 25.06.2026 and consequently direct the second respondent to provide adequate police protection as from 10.07.2026 to 17.07.2026 for the renovation work of my dilapidated house forthwith.

¶2The learned counsel for the petitioner submitted that the petitioner is residing in a 80 years old house, which is in a dilapidated house. When the petitioner proceeded to renovate the house, the brother of the petitioner has obstructed the same by making life threats to the petitioner. Therefore, the petitioner has made a representation before the respondents. Since the same was not considered, the present writ petition is filed.

3.The learned Government Advocate submitted that the house for which the petitioner is seeking police protection is the subject property in OS .No.50 of 2023, which is pending on the file of the learned District Munsif Court, Thirumayam and hence the police cannot meddle in the same. The petitioner has sent the representation to the first respondent and the second respondent is yet to receive the same.

¶4The learned counsel for the petitioner submitted that since the house is in a dilapidated condition, which may fall at any point of time and the permission which is sought is only to maintain the said house, failing which the petitioner and his family's lives would be in the endangered.

¶5Heard either sides and carefully perused the materials available on record.

¶6Considering the pendency of the civil suit between the petitioner and his brother and also the fact that the house is in dilapidated condition, this Court is of the considered opinion that the petitioner may be permitted to just renovate the house, preserving the existing structure of the house. Since the learned Government Advocate submitted that the representation is not yet received by the second respondent, on receipt of the representation, the second respondent police is directed to afford necessary police protection to the petitioner on payment of necessary charges in terms of the in terms of G.O(Ms)No.139, Home (Pol-VIII) Department, dated 04.03.2019. It is made clear that the petitioner should not make any changes in the existing structure rather than restoring the strength of the building.

¶7With the above directions, this Writ Petition is disposed of.
