Judgment
ORDER This Writ Petition is filed seeking to issue a Writ of Mandamus directing the second respondent to take appropriate action against the respondents 3 to 5 by conducting an enquiry based on the petitioner's representation dated 18.06.2026.
¶2The learned counsel for the petitioner submitted that the petitioner is a helpless woman who had borrowed an amount of Rs.20 lakhs from the third respondent. Having repaid 10 times the amount borrowed, the third respondent along with 4th and 5th respondents are continuously pestering the petitioner for payment of more and more money. Pursuant to which, the petitioner had lodged a complaint before the respondent police on 19-6-2026 at 11.00 hours and CSR No. 113/2026 was also issued. However, the respondent police having playing hand and glove with the private respondents, closed the complaint and therefore, sought the indulgence of this Court.
¶3The learned Government Advocate submitted that it was closed only at the instance of the petitioner who had given a written undertaking, where she had accepted to approach the appropriate civil Court.
¶4Heard either sides and carefully perused the materials available on record.
¶5The undertaking given by the petitioner was placed before me. In view of the same, the respondent police is directed to reopen the complaint in CSR No.113 of 2026 with all necessary documents which would substantiate the claim that the petitioner had paid 10 times the amount which she had borrowed from the third respondent. It is made clear that the second respondent police should take strict action if the petitioner's complaint is found true in letter and spirit. The first respondent is directed to monitor the investigation and ensure justice to the petitioner. The second responder is directed to appraise the progress in the investigation every Friday to the first respondent.
¶6With the above direction, this Writ Petition is disposed of.
